Edward Murphy has sued The Day Publishing Co., his former employer, for not rehiring him after he was laid off.
Murphy was the custom publications editor when he was laid off in April 2009. In December 2010, Murphy applied when The Day advertised a custom publications editor position. In his lawsuit, Murphy said the job he had held and the advertised position were "indistinguishable in any material respect."
Murphy, 59, of Waterford, claims he did not get the job because of his age and gender.
After Murphy was laid off, he sued The Day for age discrimination. The Day and Murphy "resolved the dispute," but The Day retaliated by not rehiring him in 2010, according to the most current lawsuit.
"We don't think Ed's allegations align with the facts in this case. We look forward to the opportunity to have our day in court," said Publisher Gary Farrugia.
