Milford (AP) - Milford's school superintendent is defending her decision to bar a third-grader from returning to school after visiting West Africa because of concern the girl may have contracted Ebola.

The father of Ikeoluw Opayemi has filed a federal lawsuit saying the decision violated the Americans with Disabilities Act, because it discriminates against his daughter for a "perceived impairment."

Stephen Opayemi's lawsuit says there is no Ebola in Nigeria, the country they visited, and the decision to keep his daughter home until Nov. 3 is irrational. He is seeking an immediate return of his daughter to school and unspecified monetary damages.

School Superintendent Elizabeth Feser said in a statement Wednesday that her actions were a good-faith response to a public health issue and in the best interest of all students.
