    Montville man arrested after allegedly smoking pot with three juveniles

    Montville — State police on Tuesday arrested a convicted felon after he allegedly invited three juveniles into his home Saturday and smoked marijuana with them, according to police.  

    David Berry, 49, of 11 Idaho St., Oakdale, was charged Tuesday on a warrant with three counts of risk of injury to a child.

    According to an arrest warrant affidavit written by Trooper Michael Browning, the investigation into the incident began around 6 p.m. Saturday.

    Around that time, Browning wrote, he visited the home of a fourth juvenile — one who had been with the three juveniles but did not enter the home with them — to hear his version of things, as well as his father's.

    According to police, the 10-year-old's father said a neighbor, who is a family friend, called him at 5 p.m. that day and said his son was at her house.

    The father said he went to the neighbor's house, where his "emotionally distraught" son told him he'd seen Berry using drugs with his three friends, aged 10, 10 and 13.

    With his father present, the juvenile told Browning that he'd been walking around the neighborhood with the boys earlier on Saturday when they decided to knock on Berry's door. They knew Berry from past experiences in the neighborhood, the boy said.

    According to the boy's written statement, Berry invited everyone but him inside and told him to come back later.

    It was when he came back later that he saw the marijuana being used and immediately left to go to the neighbor's house, he said.

    Browning subsequently interviewed the other three juveniles, each time with a parent present, and got slightly varying versions of the same story.

    One boy said the marijuana they allegedly smoked was Berry's.

    Another said the 13-year-old had used $40 to purchase marijuana on Friday and it was that marijuana they allegedly smoked with Berry on Saturday — Berry just helped roll the joint, he said.

    According to the affidavit, the 13-year-old, who said he'd met Berry in the neighborhood prior to Saturday, didn't initially admit to buying marijuana on Friday, but later confessed to his mother, who called Browning.

    All three boys said Berry offered them alcohol, which only the 13-year-old accepted, and all three said Berry said something like, "What happens in this house, stays in this house."

    They also said they never felt threatened and weren't held against their will.

    According to the affidavit, Berry, a convicted felon, has 14 arrests in Connecticut and "several more" in Rhode Island for charges ranging from robbery and forgery to breach of peace and violation of probation.

    State police and Montville police worked together on the investigation.

    Police said Berry was held on a $50,000 bond and appeared in court Wednesday.
