State drops sex assault charges against Colchester man, cites credibility of witness
The state dropped all criminal charges Wednesday in New London Superior Court against a Colchester man accused of sexually assaulting a young girl.
Assistant State’s Attorney Theresa Ferryman said in court that she would not proceed with the prosecution of 55-year-old John Godinez “due to a change in circumstances that has affected the credibility of the key witness in this case.”
Jury selection in the case started on May 11. Godinez was charged with risk of injury to a minor and second-degree sexual assault.
Defense attorney Linda Sullivan asked Judge Patrick Clifford for an immediate dismissal of the charges, which he granted.
Godinez was arrested last March after an investigation by state police into an alleged sexual assault complaint. The girl claimed Godinez sexually assaulted her between the ages of 7 and 14.
