    Home invasion, assault charges dismissed as New London case headed for trial

    A New London Superior Court judge on Monday dismissed charges against a Tibetan man who was accused of forcing his way into an apartment at 30 Montauk Ave. in New London on May 28, 2016 and assaulting its occupants.

    Judge Hillary B. Strackbein dismissed the charges against the 47-year-old man, known only as Gyamkhu, after Senior Assistant State's Attorney Stephen M. Carney said the state would not be prosecuting him. Carney said that while preparing for trial, the state was told, by a significant witness, that Gyamkhu had been invited into the home. The state learned also that a key witness was no longer available to testify.

    Gyamkhu, who was represented by attorney Bruce B. McIntyre, had maintained his innocence while the case was pending. In resolving the case, he agreed to make a $1,000 donation to a victim's compensation fund.

    New London Police charged Gyamkhu with home invasion, second-degree burglary, second-degree assault, three counts of third-degree assault and risk of injury to a minor after responding to reports that a male had knocked on an apartment door stating he had been struck by a woman, according to an incident report. Police located Gyamkhu, who was bleeding from a head wound and indicated his cell phone was stolen. Police had difficulty communicating with him, as he didn't speak English, according to the report.

    Officers followed a trail of blood to a second-floor apartment, where they found pots and pans, broken dishes and blood strewn about the kitchen floor. The occupants reported that the man had knocked on the door and forced his way into the apartment and an altercation ensued. Three occupants of the home had sustained puncture wounds from being bitten and one had a head wound from being struck on the head with a frying pan.  

    One of the alleged victims, a woman, told police that the man later identified as Gyamkhu had waved her over on Green Street, asked for her phone number and offered to pay her $20 for sex, according to the report. She said she was walking toward State Street, where she stopped for something to eat, then returned to Montauk Avenue. She said she saw the man in her daughter-in-law's apartment, and that a struggle ensued in which Gyamkhu at one point pinned a one-year-old child against a wall with his leg.
