Mother of alleged victim testifies at Waterford man's sexual assault trial

The mother of a teen who alleges that Jarah M. Davis plied her with liquor and sexually assaulted her at his Waterford home in May 2015 broke down briefly as she testified Wednesday at Davis' trial in New London Superior Court.

Davis, 29, has pleaded not guilty to charges of first-degree sexual assault, second-degree sexual assault of a person who was physically helpless and delivery of alcohol to a minor. A jury of six members and two alternates, all but one of them male, listened to testimony from the mother and several others Wednesday as prosecutor Theresa Anne Ferryman continued to present the state's case.

The alleged victim's mother, who works as a nurse, testified she allowed her daughter to sleep over at the Davis home on Mary Street after her family and Davis and his wife attended a graduation party in Niantic on May 23, 2015. She admitted that during the party, she gave her daughter, then 16, permission to drink two beers. She said her daughter was sober when she left the party and that Davis and his wife, Kaitlyn, who also were drinking, seemed fine.

The woman said her daughter and Kaitlyn Davis were "very friendly," and that she didn't know Jarah Davis well because Davis, an Army soldier, often was on deployment.

The mother cried as recounted how her daughter told her the next day that "something awful had happened" at the Davis house.  She said she was afraid to tell her husband about the incident for fear he would have a heart attack or stroke. When she finally told him a day later, she said relatives who also work in the medical field were sitting in their cars in the driveway in case he needed Cardiopulmonary Resuscitation. After speaking with the relatives, she took her daughter to the emergency room at Middlesex Memorial Hospital, where the teen underwent a sexual assault examination.

The alleged victim had testified Tuesday that she was so intoxicated after drinking scotch, vodka and tequila with Davis in his finished basement that she could not move or speak when he had sex with her. She admitted under cross-examination by defense attorney Michael A. Blanchard that she was so drunk, she could not recall some details of the incident.

On Wednesday, Waterford police Sgt. Nicole D. VanOverloop testified that she began investigating after receiving a report from the Department of Children and Families, who had been alerted by the hospital. VanOverloop conducted a videotaped interview of the alleged victim, obtaining a sworn, signed statement, collected the victim's medical records and attempted to interview Davis, who refused, he said, based on the advice of an attorney. With his permission, she went to his home in August 2015 and swabbed his cheek to obtain a DNA sample. The sample was compared at the state forensic laboratory with sperm found in a vaginal swab taken from the alleged victim.

VanOverloop said she applied for an arrest warrant affidavit after the laboratory notified her that Davis' DNA was found in the sample taken from the victim. Under cross-examination by defense attorney Bryan P. Fiengo, VanOverloop admitted that when she went to the Davis home to collect the DNA sample, she did not inspect the Davis home, or the finished basement where the crime allegedly occurred. She said too much time had passed since the alleged crime and no one disputed that Davis and the teen had been in the home.

The jury also heard Wednesday from other family members of the alleged victim and DCF investigator Peter Woycik, who interviewed Davis after receiving a complaint of neglect and sexual abuse through the agency's Careline. He testified that Davis admitted to giving the teen ½ shots of alcohol but said the sexual abuse allegation was "an absolute lie."

    The trial resumes Thursday.
