WESTFIELD, Mass. (AP) — Police say a Westfield mother whose 1-year-old son was taken to the hospital last month for a suspected heroin overdose is shielded from some charges by the state's good Samaritan law.

Detective James Renaudette tells the Boston Herald the 31-year-old woman will be called to a hearing before a clerk magistrate, who will determine if there's enough evidence for a misdemeanor child endangerment charge. The summons is based on the discovery of empty heroin bags and syringes in the family's apartment.

But he says the good Samaritan law protects anyone who seeks medical assistance for an overdose.

The head of the state's health services agency said the child was given Narcan. Police have said the overdose was "unsubstantiated."

The boy's father says his son may have choked on something.
