Waterford – A man involved in a 2012 car accident with a vehicle belonging to Oswegatchie Fire Company is suing the town, fire company and driver of the town vehicle for injuries he said he sustained in the accident.
Joseph Rauscher, 44, of Danielson, complained of back and neck pain and was taken to Lawrence + Memorial Hospital for examination after a May 19, 2012 accident on Rt. 85. According to a police report provided by Rauscher’s lawyer, Stephen Reck, Rauscher's Dodge van was rear-ended by a town-owned Ford truck.
The lawsuit alleges that negligent actions of the town, fire company and driver resulted in Rauscher suffering lasting back, spine and neurological injuries.
Reck said he is seeking $500,000 in damages on behalf of his client, but that the town insurance offered only $25,000.
First Selectman Daniel Steward said the town plans to leave the lawsuit in the hands of its insurer. He said he does not expect any financial responsibility to fall on driver Jason Finnigan, who he said either works or volunteers for the fire company.
