Former Mitchell College maintenance worker gets settlement for compactor accident

A former Mitchell College maintenance man who suffered severe leg injuries three years ago when a pickup truck driven by a co-worker pinned him against the college’s trash compactor has obtained a settlement of $735,000 following mediation in Superior Court, according to his attorneys.

Ismael Alvarado had sued the college and the co-worker, Aurura Martinez, for negligence and carelessness following the June 2, 2012, incident, which left him permanently disabled and using a cane, according to attorneys Shelley L. Graves and Dale P. Faulkner. The case was scheduled to go to trial this month but was settled after two mediation sessions with Robert Holzberg, a retired Superior Court judge.

Alvarado, 47, was satisfied with the settlement, Graves said in a press release.

According to court documents, Alvarado had backed up the pickup truck to a metal trash compactor on an access road at the New London campus and placed bags of trash in the compactor. As he was closing the compactor door, Martinez accidentally drove the truck in reverse, pinning Alvarado. He yelled to Martinez to drive the truck forward and call 911. She moved the truck, but was so upset she could not make the call, according to the press release. Alvarado called himself.

Alvarado underwent a lengthy surgery at Yale-New Haven Hospital during which screws, wires and plates were installed in his leg followed by a long course of physical therapy, according to his attorneys.

Attorney Kirby Huget of Hartford, who represented the college and Martinez, could not be reached for comment.
