Norwich man returns to court third time in child porn case

A 28-year-old Norwich man who had no criminal history before he pleaded guilty in 2015 to possession of child pornography has returned to New London Superior Court for the third time.

Yamil Cabrera was arrested in 2014 for downloading files of children engaged in sexual acts after city police conducted a forensic examination of his electronic devices and found 21 sexual videos of children who obviously were under the age of 16 and more of young people whose age could not be determined.

At the time, Cabrera was living with his mother at 90 North St. He pleaded guilty in 2015 to third-degree possession of child pornography, and Judge Hillary B. Strackbein sentenced him to five years in prison, suspended after serving the mandatory minimum sentence of one year of incarceration, followed by 10 years of probation and registry as a sex offender. He is prohibited from unauthorized contact with minors and is subject to searches of his phone and use of other devices.

He was released from prison in 2016 and began serving his 10 years of strict probation. He was charged with a probation violation in February 2018 after his probation officer discovered he was using an unapproved Facebook account. He admitted the violation and was sentenced to an additional 90 days of incarceration.

Released in April 2018, he was arrested two months later when his probation officer reported he was seen on the grounds of Norwich Free Academy, was in possession of an unapproved smartphone with an unapproved Facebook account and child pornography. He also was found to be in possession of a facsimile firearm, according to prosecutor Theresa Anne Ferryman.

Strackbein sentenced Cabrera on Tuesday to an additional six months of incarceration. His probation will resume upon his release.

His attorney, Kevin C. Barrs,  said Cabrera had been working full time at the time of his arrest and is looking forward to putting the case behind him.

The judge told him, "You have to follow the rules of probation. You think you're not going to get caught. You will get caught."
