    State will not prosecute New London restaurateur on drug charges

    The state will not be prosecuting Joshua Feldman on narcotics distribution charges, since he's already facing consequences for the same offense in federal court.

    Feldman, the 47-year-old co-owner of Noble restaurant on Bank Street, is one of the 26 New London-area defendants indicted in 2019 on federal drug trafficking charges. He pleaded guilty in June 2019 to conspiracy to distribute and possession with intent to distribute 50 to 100 grams of cocaine.

    The nolle means that the district will not prosecute Feldman’s case — if he doesn’t get into any legal trouble in the next 13 months, his case will be dismissed in New London District Court.

    State’s Attorney Paul Narducci for the judicial district of New London said Feldman was facing narcotics charges at both the state and federal levels. The case was nolled at the state level because, according to state statute, a person cannot be prosecuted by federal authorities and the state for the same narcotics violations.

    Narducci said he met with Feldman’s attorney in a pretrial conference Wednesday.

    Feldman's attorney, Robert Golger, said Friday that Feldman has completed a one-year "court support" program for those who struggle with alcohol or drug addiction.

    His sentencing was postponed while he was enrolled in the program and has been rescheduled for Feb. 24, according to his attorney.

    Under federal sentencing guidelines, which are not binding, Feldman faces 10 to 16 months in prison, a minimum term of three years of supervised release and a fine of up to $55,000.
