A federal appeals court in New York has ruled that the town of East Haven is not liable in a Connecticut police shooting case.

The decision was released Wednesday by the 2nd U.S. Circuit Court of Appeals.

Emma Jones was seeking a new trial on compensatory damages against the town for the 1997 shooting of her son, Malik Jones.

The 2nd Circuit said the evidence was insufficient to hold the town liable. A lawyer for Jones did not immediately return a call for comment.

A federal jury in Hartford did not award compensatory damages in a 2003 verdict. The jury did award $2.5 million in punitive damages, but a federal judge rejected it.
