    UConn students charged in student's death appear at court

    Six University of Connecticut students charged in connection with the death of UConn student Jeffny Pally appeared at Superior Court in Rockville on Wednesday, but did not go before a judge.

    Lawyers for the six students met briefly with prosecutors, and then were given new court dates for their clients.

    The six students were affiliated with the Kappa Sigma fraternity, which hosted a party at a house at 51 Baxter Road. Pally, 19, of West Hartford attended the party prior to the incident that resulted in her death.

    Pally was killed when a UConn fire department vehicle ran over her. After a night of drinking that began before she went to the fraternity party, Pally was dropped off back on campus. Rather than return to her dorm, where she was a resident assistant, she crouched down, leaned against a fire department garage door and fell asleep or passed out. About 30 minutes later the fire department got a call, the garage door opened and Pally fell backward.

    Pally was then run over by a Chevy Tahoe SUV driven by fire department shift commander Dana E. Barrow Jr., 60. A prosecutor said Barrow will not face charges because he could not have seen Pally.

    According to court records, toxicology testing revealed that Pally's blood alcohol content was .25, more than three times what is considered legally drunk in Connecticut.

    The six charged are:

    Patrick Callahan, 21, Matthew Moll, 21, and Dylan Morose, 22, all of 51 Baxter Road, Mansfield; each charged with eight counts of permitting a minor to illegally possess alcohol. They were the hosts of the party where Pally was seen consuming alcohol prior to her death, according to the arrest warrant.

    Austin Custodio, 21, of Boyce Road, Pine Bush, N.Y.; charged with sale or delivery of alcohol to minors. Custodio is accused of buying the beer and vodka consumed at the party at 51 Baxter Road.

    Dominic Godi, 21, of Meadow Road, Bolton; charged with conspiracy to commit sale or delivery of alcohol to minor. Godi was social chairman of the Kappa Sigma fraternity and after Custodio purchased the alcohol Godi transported it to 51 Baxter Road, according to the warrant.

    Jonathan Polansky, 22, of Sherman Street, Beverly, Mass., charged with eight counts of permitting a minor to illegal possess alcohol. At the time of the party, Polansky was on the lease at 51 Baxter Road and attended the party, according to the warrant.

    All were released from custody without having to post bail.
